1. Introduction
Welcome to our platform. By using our services, you agree to these terms which form a binding agreement between you and us.
2. User Responsibilities
You agree to provide accurate information and to keep your account secure. You are responsible for all activity that occurs under your account.
3. Privacy & Data
We collect and use information as described in our Privacy Policy. Your acknowledgement will be recorded with a timestamp.
4. Acceptable Use
Do not use the service for unlawful purposes. Abusive behaviour may result in account suspension or termination.
5. Changes
We may update these terms from time to time. We will notify you of significant changes.
6. E-Invoicing
Where required under Malaysian law, we issue e-Invoices through the Inland Revenue Board of Malaysia (LHDN) MyInvois system, in accordance with the Income Tax Act 1967 and LHDN's e-Invoice guidelines. By using our services you acknowledge and agree that:
- Your choice. You may choose, at the time of each purchase, whether you need an e-Invoice issued in your name. If you do not request one, we will issue a standard invoice, and your transaction may be included in a consolidated e-Invoice submitted to LHDN as permitted by law. A request for an e-Invoice must be made at the time of purchase and cannot be made later.
- Accurate billing information. If you request an e-Invoice, you must give us complete and accurate billing information, including your registered or legal name, Tax Identification Number (TIN), business registration number (SSM) or identity card number, SST registration number (if applicable) and address. You are responsible for keeping this information up to date.
- Talents with ongoing work. Because we incur platform and escrow charges on completed work, e-Invoicing must remain enabled while you have an ongoing job or quotation, and is enabled automatically when you apply for a job or submit a quotation.
- Submission and corrections. E-Invoices are submitted to LHDN once issued. An e-Invoice that has been validated by LHDN can only be cancelled within the period allowed by LHDN (currently 72 hours). After that period, corrections will be made by credit note, debit note or refund note, as applicable. We are not responsible for delays or errors caused by incorrect information you provide.
- Data sharing. You consent to us collecting, processing and disclosing your billing information to LHDN, our accounting and e-Invoice service providers (including Bukku), and other parties as required by law, in accordance with the Personal Data Protection Act 2010 and our Privacy Policy.
- Records. Your invoices and related records are kept for the period required by Malaysian law.
